prioritizing patient safety and data privacy. These Terms and Conditions outline your
rights, our service standards, and payment guidelines to ensure a seamless, secure
experience for all.
By using our website or any of our channels, you agree to this Policy. If you disagree,
please do not use Healthoxy’s services.
Terms and Conditions for Healthoxy Caregiver & Nurses Service
Healthoxy (Healthoxy Healthcare Services Pvt Ltd) aims to provide excellent care by focusing
on patients and using technology. We need your cooperation for best results. Please read
this Agreement carefully as it outlines the understanding between you (the “Patient”) and
HealthOxy (the “Agency”) regarding the services you have requested. If you have any
questions, please ask our authorized representative.
2. Key Points
- Service Explanation: A HealthOxy representative will clearly explain the services to you or your family member.
- Service Categories: The difference between service categories and what they include will be explained.
- Shift Timings: Shift timings will be confirmed during the onboarding process.
- Care Assessment: Each patient will undergo a standard care assessment and receive supervision as per our protocols.
- Staff Assignment: Staff will be assigned based on care needs. And staff profiles will be sent before the onboarding process. If staff is not available, we will make alternative arrangements.
- Service Pause: If unavoidable circumstances arise, services may be temporarily paused until alternative arrangements are made.
- Booking and Payment:
- Payment for services is required in advance.
- If the same employee works during their leave or public holidays, additional
charges may apply.
- The cost of supplies used by the staff for care will be billed separately.
- Transportation charges may vary depending on the patient's travel needs.
- If staff are injured during service, the family is responsible for their
treatment.
- Any equipment used will incur a cost, and the family must ensure proper
conditions for its use.
- All outstanding payments must be settled before the patient is discharged.
- If payment is not made, HealthOXY may pause services until payment is received.
Patients will be updated regularly on the status of their payments
- Monitoring and Follow-up: Your needs will be reviewed by a supervisor,
and services may change accordingly
- Signature: By signing below, you confirm that you understand and agree
to these terms.
- Medical Records: At the end of service, the nursing supervisor will
provide a closure report.
- Use of Services: You agree to use our services for lawful purposes and
in accordance with these Terms & Conditions. You may not use our services for any
illegal or unauthorized purpose, including but not limited to violating any applicable
laws or regulations.
- Eligibility: You must be at least 18 years old to use our services. By
accessing our website or using our services, you represent and warrant that you are at
least 18 years old and have the legal capacity to enter into this agreement.
- Account Registration: In order to access certain features of our
services, you may be required to register for an account. You agree to provide accurate,
current, and complete information during the registration process and to update such
information as necessary to keep it accurate, current, and complete.
- Privacy: Your privacy is important to us. Please review our Privacy
Policy to understand how we collect, use, and disclose your information.
- Intellectual Property: The content on our website, including but not
limited to text, graphics, logos, images, and software, is the property of HealthOxy and
is protected by copyright and other intellectual property laws. You may not use,
reproduce, modify, or distribute any content from our website without our prior written
consent.
- Governing Law: These Terms & Conditions shall be governed by and
construed in accordance with the laws of [insert jurisdiction]. Any dispute arising out
of or related to these Terms & Conditions shall be subject to the exclusive jurisdiction
of the courts located in Tis Hazari, New Delhi.
- Amendment: Healthoxy reserves the right to amend or update these Terms
& Conditions at any time without prior notice. Any changes to these Terms & Conditions
will be posted on our website.
3. Proactive Service Checks
When you use services from Healthoxy such as caretaker, nurse or medical equipment rental,
our dedicated team may visit your home with or without notice. This visit is to ensure that
you are receiving the best possible care and to check that all medical equipment is working
properly, ensuring your peace of mind and safety.
4. Responsibility During Caretaker
Unavailability Due to Unforeseen Events
If our caretakers or nursing staff are unable to attend to your patient due to circumstances
beyond our control—such as national holidays, festivals, natural disasters, curfews, or
other unforeseen events—we will promptly inform you. During this time, you will have to take
responsibility for your patient yourself. Please be prepared to take responsibility for the
patient's immediate needs at such times.
5. General Terms and Conditions
- Contract Term: This contract begins on the signature date and lasts for
one year or until services end, unless extended or terminated earlier.
- Payments to Employees: Employees must not be paid directly in cash or
online unless approved by management.
- Fees: Fees include all applicable taxes, but do not include GST.
- Service Limitations: Healthoxy employees will only perform the services
outlined in this contract. Changes must be in writing and signed.
- Facilities: Employees' basic needs (food, accommodation) must be
provided by the family.
- Domestic Work: Healthoxy staff will not perform domestic work such as
cleaning or cooking.
- Respect for Employees: Healthoxy staff must be treated with respect by
the family.
- Holiday Policy: Staff may earn one holiday day for every 7 days worked.
- Staff Replacement: Healthoxy reserves the right to replace staff if
necessary, ensuring that replacements are equally qualified.
- Termination: Either party may terminate the agreement with 24 hours
notice or by mutual consent. Immediate termination may occur if obligations are not met.
- Non-Request: The family may not hire Healthoxy staff for 12 months
after termination of the agreement. Violation of this will result in damages equivalent
to three months' pay.
- Contract Validity: This Agreement is valid until the death of the
Beneficiary. No refund will be issued in case of death or transfer.
- Governing Law: This Agreement is governed by Indian law, and disputes
will be settled in the courts of New Delhi.
6. Liability and Indemnity

Safety: Your safety is a priority, but you acknowledge that there is risk in receiving
the Services. By accepting the Services, you agree to share responsibility for safety.

Liability: Healthoxy is not liable for any infection, injury or death caused by the
Services. You release Healthoxy from any claims related to these issues.
- Indemnity: You agree to indemnify Healthoxy for any claims resulting from personal
injury, illness or property damage sustained by you or others on our premise
7. Payment Policy
- Applicable Services: All Services including Attendant, Nursing
Care, Critical Care, Physio, Medical Equipment, Nursing Short Visits, Dressing,
Injection, etc.
- Direct Payment Prohibition: You cannot pay Healthoxy's caretaker or
nurse directly unless Healthoxy says so in writing. If you do this, you will be
responsible and may have to pay double the money to the company.
- Payment Mode: Online, NEFT, Debit Card (with 2% extra charge),
Credit Card (with 3% extra charge), and Cash payments are accepted. Healthoxy promotes
online advance payments to ensure timely caregiver payouts.
- Payment Information: Payments can be made via Healthoxy's QR code,
payment link, or official bank account. RazorPay, Cashfree, and Airpay options are also
available on the website.
- Don’t Pay To Any Other Account: Payments must be made only to the
official Healthoxy account. Do not pay to any team member's personal account.
- Safety: Beneficiaries accept all risks associated with the services
and release Healthoxy from liability.
- Control: Healthoxy is not liable for actions beyond its control or
those under the Beneficiary’s direct supervision.
- Indemnity: Beneficiaries agree to indemnify Healthoxy for any
claims arising from their negligence.
- Authorization: Beneficiaries give consent to treatment, release of
medical records, and communication with doctors.
- Consent: Beneficiaries agree to treatment, take responsibility for
outcomes, and permit the use of photos/videos for educational/promotional use.
- (K) Emergency Treatment: Healthoxy is authorized to provide or arrange
medical treatment during emergencies.
- (L) Patient Critical Care Disclaimer: Healthoxy provides staff based on
the information shared by you. If the patient is critically ill and something happens,
Healthoxy and its staff are not responsible.
- (M) Staff Assignment Timeline: After booking, allow at least 24 hours
for staff assignment to ensure proper service quality.
- (N) Staff Assignment Policy:
- You cannot reject a staff member without first assessing their capability.
- Replacement will be provided if the staff cannot perform duties.
- Healthoxy will try to match your preference but does not guarantee the same
staff every day.
- Any qualified staff may be sent without notice if necessary.
- If the preferred staff is unavailable, another qualified staff profile will be
shared.
- (O) Hospital & Home Details: If the patient is in a hospital, both
hospital and home addresses must be provided.
- (P) Disclosure of Patient’s Condition: You must provide full and honest
medical details so that appropriate staff can be assigned as per patient needs.
8. Healthoxy Service and Agreement Guidelines
- Service Contract: A service contract is entered into with the company
at the time of booking the service.
- Appointment and Booking Confirmation: Appointments and bookings with
Healthoxy can be made through the Healthoxy website or mobile number. You can then
request the service and inform the Healthoxy agent of the booking amount. You will be
eligible to avail the service once the company receives your payment receipt.
- Booking Schedule: If you book the service after 6 PM, then staff will
be provided to you within 24 hours.
- Contract with the Client: Before starting HealthOxy’s services, a
manual contract must be signed. Only after completing this process, you will be eligible
to receive the service.
- Client Advisory – Independent Agreement with Caregiver Staff: When the
Healthoxy team visits the client's home for contract signing, an additional agreement is
also signed between the company and the caregiver staff. This agreement is solely
between Healthoxy and the caregiver, and the client cannot prevent this arrangement. It
ensures transparency and clarity in service delivery.
9. Termination
- Patient Complete Details: You must not hide anything about the
patient's illness. All health conditions must be disclosed. If any illness is hidden,
the company reserves the right to terminate the service at any time.
- Staff Respect: Delays may occur due to traffic, medical emergencies, or
other unforeseen circumstances. Clients must not misbehave or act rudely with the
caretaker or nurse. Any such behavior may lead to immediate termination of services
without a refund.
- Non-Payment After Service: If the client fails to pay the due amount
after the service is rendered, a penalty of ₹100 per day will be applied until the
payment is cleared.
- Overdue Payments: Healthoxy reserves the right to suspend or terminate
services immediately in case of prolonged overdue payments, even after multiple
reminders. Services can only resume after all dues are settled along with the ₹100 per
day delay penalty.
10. Medical Equipment Terms & Conditions
- Rental Equipment Damage and Liability Policy:
- The equipment should be thoroughly inspected at the time of renting. After that,
if any physical damage occurs, the customer will be responsible.
- If the equipment or its accessories are damaged or stolen during the rental
period, the customer must pay the full cost. No excuse will be accepted.
- Rental Period Policy: Early Return and Late Extension Guidelines:
- If the equipment is returned before the stipulated rental time, the customer
cannot claim any refund for the remaining period.
- If the equipment is not returned on time, the company may charge rent for the
full month, even if delayed by a single day or hour.
- Understanding Equipment at Delivery: A free demo will be provided
at the time of delivery. If a physical demo is requested again after installation, ₹1000
per visit will be charged. Online video demo will be free.
- Customer Responsibility for Equipment Care: The customer is solely
responsible for the equipment as per the issued invoice.
- Equipment Replacement Policy and Service Hours: Replacement of
equipment/accessories is subject to company discretion. Services are available only
between 9 AM and 10 PM.
- Rental Extension and Return Notification: It is the customer's
responsibility to notify the company for any rental extension or equipment return.
Failure to do so will imply extension and additional charges will apply.
- Customer Identification and Dispute Jurisdiction: The customer is
the person in whose name the invoice is issued. All disputes fall under Delhi
jurisdiction.
- Rental-Only Policy: The company provides only rental services;
medical equipment is not for sale.
- Non-Refundable Amount: No refunds will be issued under any
circumstances.
- For Medical Equipment Rental: Required documents include a PDC
cheque, Aadhaar copy, online payment/cash security, or valid address proof. Any damage
will be chargeable to the customer.
11. Brief Home Visit By Nurses/On-Call Services
- Urinary Catheterization:
- Please ensure the urinary catheter is checked thoroughly for leaks and proper
urine flow during installation.
- If any issues arise after installation and you call the team again, a revisit
fee will be charged.
- Ryle’s Tube Change at Home:
- This procedure is conducted by trained professionals and checked immediately
after completion.
- If any doubts arise, contact the team immediately. Healthoxy and its employees
are not liable for any incident during or after the process.
- Tracheostomy Tube Change at Home:
- Handled by skilled technicians, the tube is thoroughly checked post-procedure
for proper functioning.
- All concerns should be raised before the technician leaves. Healthoxy is not
responsible for any issues after the visit. A revisit fee applies for
follow-ups.
- Wound Dressing:
- Our professionals provide proper wound dressing at home and ensure comfort and
safety.
- Any discomfort should be reported during the visit. If raised afterward, a
revisit fee will apply.
- Injection & IV Infusion Service At Home:
- Professionals administer injections and IV infusions with care and verify there
are no complications afterward.
- If any concerns arise after the visit, an additional fee will be charged for
another visit.
Note: All services are performed by trained professionals and thoroughly checked
post-procedure. Raise concerns during the visit to avoid extra charges.
